Lawsuit involving Dairy Queen pulled

An independently owned Dairy Queen in Eau Claire has withdrawn its lawsuit against a Minneapolis-based ice cream and fast food company.

Maureen and John Robertson, owners of the Dairy Queen on Menomonie Street, filed the lawsuit in July against American Dairy Queen Corporation, alleging the company sabotaged a deal for control of the brand name in Eau Claire County. Their attorney wrote to the company on behalf of the couple that said they decided to voluntarily dismiss the lawsuit on August 28th.

The lawsuit stated the Robertsons offered to buy exclusive rights to use the Dairy Queen name in July 2014 from local business entity Stephen Partnership, which held those rights since 1959. They allege that when American Dairy Queen heard about the deal, the corporation said it could kill the sale. In December 2014, the corporation bought the rights from Stephen Partnership at a price lower than what the Robertsons offered. Since then, the Robertsons say the Dairy Queen corporation also threatened to stop them from using the DQ name because they failed to provide reports and sold unapproved products.
